1. The AEON x Visa 39th Anniversary Shop & Win Contest (“Contest”) is organized by AEON CO. (M) BHD. [Company No.: 198404014370 (126926-H)] and Visa Worldwide Pte. Limited [200719281K] (“Visa”) (Collectively referred to as the “Organizers”).

2. The Contest shall commence from 1st October 2023 to 30th November 2023 (“Contest Period”). The Organizer shall reserve the right to revise or modify the Contest Period at any time without prior notice or assign any reason whatsoever. Any entries received outside of the Contest Period shall be automatically null and void without further notice.

3. This Contest is open to all (i) legal citizens and permanent residents of Malaysia; (ii) aged eighteen (18) years old and above at the commencement of the Contest Period; and (iii) are cardholders of valid Visa Card (“Visa Card”) (referred as the “Participant”).

4. To participate in the Contest, Participant must make a minimum purchase of Ringgit Malaysia One Hundred Forty (RM140) or more in a single transaction/receipt by using a single valid Visa Card, processed through the Tap and Pay method at any AEON Stores/ MaxValu Prime/ AEON Wellness/ Daiso by AEON/ myAEON2go only during the Contest Period. In order to enter into the Contest, Participants are required to perform the following:a. Scan the QR Code from the corresponding Market Collateral;b. Complete the required personal details; andc. Upload a clear photo of the Credit Card Terminal SlipParticipants are required to take note that payment methods involving the insertion of the Visa Card into a terminal machine will not be accepted as valid entries.

5. For the avoidance of doubt, Participant must attain the minimum payment amount Ringgit Malaysia One Hundred Forty (RM140) only using a single Visa card. The combination of payment methods or different cards shall not be accepted as valid entries.

6. Each Participant’s participation shall be subject to the verification of the Organizer, which the Organizers’ may at its sole discretion, include additional checks or requirements. In the event the submission’s information is false or inaccurate, or does not include the necessary proof of purchase, or does not meet the minimum spend amount, the submission will be disqualified.

7. The Organizers reserve the right to reject any entries or submissions which are incomplete, illegible, disfigured, submitted beyond the deadline or such other reasons as the Organizers deem fit.

9. Each Participant shall be entitled to win one (1) Prize only.

10. The winners of the Contest will be selected at random through a system chosen by the Organizer or any other method deemed appropriate by the Organizer at the Organizer’s absolute discretion.

11. The winners of the Contest will be announced by the month of March 2024 or on such other date as the Organizer deems fit in its absolute discretion via the Organizer’s social media, website or other platforms to be decided by the Organizer in its absolute discretion.

12. The winners of the Contest will be notified by the Organizer via SMS, email, or such other mode of communication which the Organizer deems fit in its absolute discretion.

13. The Organizer reserve the right to substitute any of the Prizes with other items of the same value at their absolute discretion.

14.The Organizer shall not be held liable in the event of non-receipt or delayed notification to the winners. For the avoidance of doubt, the winners shall provide the requested information and documentation to the Organizer including but not limited to the winner’s identification card for verification purpose to claim the Prizes.

15. All winners shall claim their Prizes within one (1) month or any other period to be determined by the Organizer in its absolute discretion, upon the notification or announcement of the winner’s list, whichever is earlier. Should the winners fail to claim the Prizes within the allocated time period, the Organizer reserves the right to forfeit the Prizes or award the Prizes to another Participant or winner.

16. In the event of a disqualification after the Prizes have been awarded, the Organizer reserves the right to demand for the return of the Prizes or payment of its equivalent value from the disqualified winner.

17. The Organizer reserves the right, at its absolute discretion, to substitute any of the Prizes with other items of similar value without any prior notice. The Organizer shall not be held liable for any losses, claims, demands, costs, damages and expenses arising from the substitution of Prizes, if any.

18. The Prizes are non-transferrable, non-returnable and not exchangeable for cash, credit, voucher and such other items in part or in full value for whatever reason. The value of the Prizes is correct at the time of printing to the best of the Organizer’s knowledge, which the Organizer reserves the right to change at any time without prior notice.

19. All Prizes are given out on an “as is” basis. The Prizes shall be used and/or taken entirely at the risk of the Participant and the Organizer excludes all warranties and liabilities in connection with the Prizes to the fullest extent permitted by law.

20. The decision of the Organizer in all matters relating to this Contest including but not limited to the selection of winners, shall be final and binding. No correspondences, queries or appeals in respect of any decision of the Organizer will be entertained.

21. The Organizer reserves the rights to withdraw, cancel, suspend, extend or terminate this Contest earlier and reserves the right to amend the terms and conditions of the Contest at any time without any prior notice. Any new or amended terms and conditions will supersede the existing terms and conditions with immediate effect.

22. By participating in this Contest, Participant agrees and consents to the use of his/ her name and photograph by the Organizer for advertising and publicity purposes.

23. By participating in this Contest, Participant agrees to be bound by the terms and condition of the Contest, the decisions of the Organizer, and all terms and conditions imposed by any sponsors and third party governing the Prizes including but not limited to the delivery and usage of such Prizes.

24. The invalidity, illegality or unenforceability of any terms hereunder shall not affect or impair the continuing enforcement of the remainder of the Terms and Conditions of this Contest.

25. The Organizer, its directors, officers, employees, agents, sponsors and/or representatives shall not in any way be responsible and liable for any claims, losses, damages, costs or expenses incurred or suffered by the Participant arising out of or in connection with the participation by the Participant in the Contest, as well the redemption and/or utilization of any Prizes won.

26. The Participant shall indemnify and keep the Organizer, its directors, officers, employees, affiliates, agents, sponsors and/or representatives ("the Indemnified Parties") fully indemnified against any and all claims, suits, costs, expenses, losses or damages (including legal costs on a full indemnity basis) suffered and/or incurred by any of the Indemnified Parties as a result of the Participant’s acts, negligence, omission or breach of any of the terms and conditions of this Contest.

27. The Organizer shall not be liable for any default of its obligation under this Contest due to any force majeure events which include but not limited to acts of God, civil commotion, acts of war, strike, riot, lockout, industrial action, fire, flood, drought, storm, epidemic and pandemic or any events and circumstances of whatever nature beyond the reasonable control of the Organizer.

28. The terms and conditions of the Contest contained herein shall be governed and be constructed in accordance to the laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.

29. The invalidity, illegality or unenforceability of any terms and conditions hereunder shall not affect or impair the continuation in force of the remainder of the terms and conditions of this Contest.

PRIVACY NOTICE PURSUANT TO PERSONAL DATA PROTECTION ACT 2010

30. In compliance with the laws of Malaysia, by participating in this Contest, the Participant hereby consents and authorizes the Organizer to collect, process, keep and disclose the Participant’s personal data in accordance with the Privacy Notice in https://www.aeonretail.com.my/privacy.html. Any withdrawal of the Participant’s consent shall be made in writing and received by the Organizers and in such event, the Participant shall be deemed to have withdrawn from this Contest.
